Privacy Notice – Jobseekers

Minit j. s. a., with its Registered Office at Košická 56, 821 08 Bratislava – mestská časť Ružinov, the Slovak Republic, Corporate ID (IČO): 51 042 487, registered in the Commercial Register maintained by District Court Bratislava I, Section: Sja, Reg. File No.: 20/B ("Minit"), processes your personal data as Controller pursuant to legislation dealing with the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("gdpr").

Minit takes the protection of personal data very seriously and cares about the protection of your personal data it processes. Through this document, Minit complies with the information obligation it owns to you under Article 13 of the GDPR.

  • How can you contact Minit in matters related to protection of your personal data?

You can contact Minit in the following ways:

  • For what purpose(s) and on what legal ground does Minit process your personal data? Is furnishing of your personal data to Minit mandatory? Who are the recipients of your personal data and how long will Minit store/archive your personal data?

We at Minit process your personal data for the following purposes:

  • to fill job vacancies / for conducting pre-contractual negotiations with prospective employees/jobseekers;
  • to maintain database of jobseekers (provided that you grant to Minit the required consent)

Ad (i)  Filling job vacancies / conducting pre-contractual negotiations with prospective employees / jobseekers

For this purpose, Minit processes your general personal data (such as academic title, name, surname, address of residence, contact e-mail address and telephone number, information concerning the attained education, and prior work experience) provided in your curriculum vitae and/or motivation/cover letter furnished to Minit in the selection process for any relevant job vacancy.

The legal ground of processing is the implementation of measures prior to conclusion of a contract upon data subject's request (legal ground under Article 6(1)(b) of the GDPR).

Furnishing your personal data to Minit is a requirement for conducting pre-contractual negotiations with you in your capacity as Minit's prospective employee and/or to conclude an employment contract or agreement on work performed outside employment between you and Minit. Should you opt not to furnish your relevant personal data to Minit, the latter would be unable to evaluate your suitability for a position and conduct pre-contractual negotiations with you.

Your personal data will be disclosed to the following recipients:

  • to Controller's authorized personnel mandated with processing of relevant personal data,
  • to GRADIENT ECM s. r. o., with their Registered Office on Košická 56, 821 08 Bratislava, Corporate ID (IČO): 31 367 232 ("GRADIENT ECM“) as owner of servers where your personal data will be stored ,
  • to Microsoft Corporation as part of delivery of the Microsoft Office services,
  • to HubSpot, Inc., with their Registered Office on 25 First Street, 2nd Floor, MA 02141 Cambridge, USA ("HubSpot“) operating the CRM system used by Minit, and
  • to companies engaged by HubSpot as additional processors involved in specific processing activities for Minit.

         Your personal data will be processed and stored during the process of selection of candidate for a job vacancy in which you are interested. Once the selection process is terminated and labour relationship between yourself and Minit is not established, your personal data will be immediately erased, unless you grant to Minit your consent to their processing for maintaining the jobseekers database.

       Ad (ii) Maintaining a jobseekers database (provided that you grant to Minit the required consent)

Should you not be successful in any relevant selection process for filling a job vacancy, you can still opt to grant to Minit your consent to be included in its database of jobseekers so that Minit be able to contact you in future with job offers that might be of interest to you. You can grant such consent by checking the appropriate box on the last page of this document.

For this purpose, Minit will process your general personal data (such as academic title, name, surname, address of residence, contact e-mail address and telephone number, information concerning the attained qualification and prior work experience) in your curriculum vitae and/or motivation/cover letter furnished to Minit in the selection process for a job vacancy.

Your consent will serve as legal ground of processing (legal ground pursuant to Article 6(1)(a) of the GDPR). The consent is granted voluntarily but it can allow you to conclude a labour relationship with Minit in the future.

For the above purpose, Minit will process your personal data for a period for which consent has been granted. You have the right to withdraw a so granted consent by writing to privacy@minit.io, and you do not need to state any reason. However, withdrawal of your consent will not affect the legitimacy of processing of your personal data by Minit under such consent prior to its withdrawal.

Your personal data will be disclosed to the following recipients:

  • to Controller's authorized personnel mandated with processing of relevant personal data,
  • to GRADIENT ECM s. r. o., with their Registered Office on Košická 56, 821 08 Bratislava, Corporate ID (IČO): 31 367 232, as owner of servers where your personal data will be stored
  • to Microsoft Corporation as part of delivery of the Microsoft Office services,
  • to HubSpot operating the CRM system used by Minit, and
  • to companies engaged by HubSpot as additional processors involved in specific processing activities for Minit.
  • Will your personal data be transmitted to a third country or international organization?

Minit intends to transfer personal data to third countries, as some of our suppliers specified above may be domiciled, or their servers may be located in the United States of America (USA), Japan, Singapore or Australia. We carry out each transfer of personal data outside the EU/European Economic Area in compliance with the provisions of the Regulation. Companies having their offices in the USA and which are certified according to the European and US privacy protection mechanisms (EU-US Privacy Shield) approved by the Commission (EU) are considered enterprises ensuring adequate level of protection. In other cases, we require that our suppliers accede to the Commission (EU) approved standard contractual clauses, or to comply with other equivalent guarantees.

Minit does not intend to transfer personal data to any international organization.

  • What are your rights in relation to processing of your personal data by Minit?

As data subject, you may exercise against Minit the following rights relating to the processing of your personal data:

  • right to request Minit to provide access to personal data concerning you;
  • right to request rectification of personal data;
  • right to erasure of personal data;
  • right to restriction of processing of personal data;
  • right to portability of personal data.

Ad (i) Right to request that Minit provide access to personal data that concern you

You have the right to obtain from Minit a confirmation whether Minit does, or does not process your personal data.

If Minit processes your personal data, you have the right to information about the type of your data subject to processing by Minit and also to the following information:

  • information about the purposes for which Minit processes your personal data;
  • what categories of personal data are processed;
  • to whom your personal data were, or will be disclosed;
  • period of storage of your personal data;
  • information about particular personal data processing-related rights that apply to you;
  • information about the right to file a complaint to the supervisory authority;
  • information about the source Minit has obtained the data from, unless the personal data have been furnished directly by you;
  • information whether your personal data are subject to automated decision-making, including profiling;
  • information about adequate guarantees of safety of transmission of your personal data, if these are transmitted to a third country or international organization.

If you exercise the right of access to your personal data, Minit will provide you with a copy of personal data it processes. Also, Minit wishes to note that provision of additional copies, i.e. should you make repeated requests, is subject to a reasonable charge covering the administrative costs incurred by Minit in that respect.

If you request access to your personal data electronically, information will be mailed to your e-mail address, unless you request different manner of their provision.

Ad (ii) Right to request rectification of personal data

If any of your personal data processed by Minit are inaccurate, you have the right to request that Minit rectify the inaccurate/incorrect personal data.

Also, you have the right to have your personal data processed by Minit completed, if they are incomplete.

Minit will rectify any incorrect personal data concerning you without undue delay.

Ad (iii) Right to erasure of personal data

You have the right to obtain from Minit the erasure of personal data concerning you without undue delay, when one of the following grounds applies:

  • your personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed by Minit;
  • you have withdrawn your consent to the processing of your personal data and there is no other legal ground for their processing by Minit;
  • your personal data have been unlawfully processed by Minit;
  • Minit must erase your personal data for compliance with legal obligations.

If Minit has made your personal data public and you have the right to request their erasure, Minit will secure in a reasonable extent the erasure of all links to, or copies or replications of those personal data.

However, your right to erasure will not apply to the extent that Minit processes your personal data:

  • for exercising the right of freedom of expression and information;
  • for compliance with a legal obligation which requires processing by the Union or Member State law to which Minit is subject, or for the performance of a task carried out in the public interest;
  • for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in so far as the exercise of such right is likely to render impossible, or seriously impair the achievement of the objectives of that processing; or
  • for the establishment, exercise or defence of legal claims.

Ad (iv) Right to restriction of processing of personal data

You have the right to obtain from Minit restriction of processing of your personal data:

  • for a period enabling Minit to verify the accuracy of the personal data, if you contested their accuracy;
  • if the processing of your personal data is unlawful and you oppose their erasure and request the restriction of their use instead;
  • for a period when you need those personal data for the establishment, exercise or defence of legal claims despite the fact that the personal data are no longer needed by Minit.

If processing of your personal data has been restricted, Minit is allowed to store such data only during the period of such restriction and the data can only be processed with your consent, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a Member State.

Ad (v) Right to data portability

If Minit processes your personal data through automated means and under your consent, or processing of your personal data by Minit is established under a contractual relationship between yourself and Minit, you have the right to portability of such personal data.

Right to portability of your personal data means that you have the right to obtain your personal data provided to Minit in a structured form and you are entitled to transmit those data to another person for subsequent processing. Also, you have the right to have those personal data transmitted to such another person directly by Minit, where this is technically feasible.

Please be advised that exercise of your right to portability of your personal data does not mean that Minit will automatically erase those personal data, and neither does the exercise of this right affect the period of storage of those personal data by Minit.

  • Does automated decision-making, including profiling, apply to your personal data?

The process of filling job vacancies by Minit does not involve automated individual decision-making, either with or without profiling.

  • To whom can you file a complaint if you believe your personal data are processed in breach of the law? 

If you believe that your personal data are processed in breach of the law, you are entitled to lodge a complaint with the supervisory authority.
