Privacy Notice

This Privacy Notice describes the manner in which we, at Minit, through our companies located in the European Union, the United Kingdom and United States listed in Section 1 below ("Minit" or "We/Us"), process and protect the personal data of our website visitors and users of our software and other products and services we offer to our customers (the "Services"). In this document, we explain all the important information concerning the type of data we collect about you, the legal basis allowing us to do so, and the purposes for which the information are processed, by whom they are accessible, how you can monitor the manner of their processing, and what technical and security measures in general we use to protect personal data. Also, you will learn about the rights in relation to processing of your personal data, and how you can exercise those rights.

We process personal data in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR"), Act No. 18/2018 Coll. concerning protection of personal data and amending certain other laws, UK Data Protection Act 2018, Dutch General Data Protection Regulation Implementation Act (Uitvoeringswet Algemene Verordening gegevensbescherming) and other applicable local data protection acts implementing the GDPR.

These information concerning processing of personal data apply to (i) our customers to whom we provide the Services, (ii) visitors of our website and persons contacting us through that website (including jobseekers contacting us through the website), (iii) persons supplying goods or providing services to us and (iv) contact persons of, or other persons authorized to act for entities referred to above.

By preparing this document, Minit fulfils the obligation to inform you (in your capacity as data subject) pursuant to Article 13 and/or 14 of the GDPR.

If you contract (including pre-contractual relationship) with any of the Minit companies in any capacity or if you provide your personal data to any of Minit companies, your data controller will be the Minit company with which you contract or to which you have provided your personal data. If you are one of our customers, the relevant data controller is Minit company with which the customer contracts.

For purposes of compliance with the GDPR, Minit j. s. a. is the main establishment as defined in Article 4(16) of the GDPR for all of our Minit companies.

2 What are Personal Data, What Kind of Personal Data Concerning You We Process And How We Collect Them?

Personal data is any information allowing to establish your identity as individual, or any information specific to you.

We at Minit collect and process only personal data that are required in order for us to:

  • provide our Services;
  • comply with all our obligations required under the law;
  • protect our legitimate interests.

When you are a customer using our software we expect that you do not provide us any personal data unless we explicitly request them. For this reason, do not feed any personal data into our software. If it is necessary that you feed data which are related to individuals, we expect and request that you anonymize them before feeding them into our software. Minit is intending not to process any personal data which are fed into its software but, to the extent that personal data is uploaded by customer to the software, Minit shall be the data processor and the customer the data controller in respect of such personal data unless otherwise agreed.

Minit will not process any special categories of personal data in the sense of Article 9(1) of the GDPR. We only process your general personal data such as name, surname, e-mail address, telephone number, company you work for, country where you work and/or other general personal data, if needed to deliver a Service requested, or the associated support.

Particular scope of personal data we collect and subsequently process depends on the type of the Service provided to you and/or the purpose for which such personal data are processed by us.

In most cases, we obtain personal data directly from you, for example when you indicate your wish to subscribe for marketing newsletters, if you contact us for whatever reason through our website, or if you, or the company you work for, conclude a contract with us (either as customer or supplier), and you happen to be such company's contact person. However, you may provide some personal data (e.g. IP address) also indirectly, namely by using our Services that collect those data in order to function properly.

When you use our Services, we also collect data describing the manner in which you use the Services. These information pertain to your interaction with our Services, such as times when you visit our website and/or what particular information you are looking for. In reliance on third party analytical tools, Minit may process the following information specific to you for the purposes of webpage personalization, browsing optimisation, analysis of your behaviour while on the website, and display of advertisement relevant to you: IP address, information concerning the device you use to connect to the website and/or access our Services, geographical location (e.g. at country or town/city level), information concerning the operational system you use, statistical data allowing us to keep track of your browsing habits while on our website (information concerning individual visits, what content you review while on the website, searches on the website, time spent on our website), as well as information obtained through cookies and other similar tools. Additional information concerning cookies, third party analytical tools and conditions of their use can be reviewed in the 'Cookies' section below.

4 To Whom We Disclose Your Personal Data?

We do not make your personal data public and neither do we disclose nor provide your personal data to any entities other than those described below.

4.1 External Suppliers

Your personal data have been made available to some of our suppliers processing such data under a personal data processing contract, according to our instructions and in conformance with this Privacy Notice. In that process, they abide by all security-related, technical and organizational measures in order to safeguard the required protection of your personal data.

4.1.1 Specific Services

Such external suppliers include the provider of the following services:

Provider of accounting and payroll services (domiciled in the Slovak Republic)

Law firms providing legal advice (domiciled in the Slovak Republic)

Providers of data storage service (domiciled in the Slovak Republic) 

Providers of CRM systems (such as HubSpot etc.)

Provider of the Helpdesk service (such as FreshDesk)

Provider of the synchronizing tool for applications used by Minit (such as Zapier)

Provider of the Microsoft Office package services (such as Outlook, Skype, SharePoint etc.)

Provider of sale outsourcing services for Minit products (domiciled in the United Kingdom)

4.1.2 Analytical And Advertising Services

Minit cooperates also with companies providing to it analytical and advertising services and participating in implementation of Minit's advertising campaigns (such as LinkedIn Corporation, Google LLC, Facebook, Inc. etc.).

These companies help us better understand how our users use our website, they place our ads on the internet, and evaluate their performance. In doing so, they may utilize cookies and similar technologies to collect information describing the manner of your interaction with our Services and also other websites. You will find more detailed information about these services, and how to protect your privacy, in the Cookies Section.

4.1.3 Developers Of Our Software Applications

Some personal data have been made available also to our developers of new software and/or updates/upgrades of existing software in order to provide our customers with Services of the highest possible quality.

4.1.4 Compliance with Obligations Resulting from Legal GDPRs

We may also store or provide/made accessible your personal data to other persons in order to comply with obligations resulting to us from the applicable legal regulations or legitimate/lawful requests received from public authorities, and to be able to enforce our claims or defend ourselves in proceedings dealing with claims enforced against us.

Such categories of recipients of your personal data include, without limitation, courts, public authorities having the legal power to supervise our activities, to resolve disputes or to enforce decisions, and/or any entities empowered to supervise archiving of documents.

4.2 Our Employees 

Your personal data will be made available Minit's authorized personnel mandated with the processing of relevant data.

4.3 Prospective Investors

If we sell any part of our business or our assets, we may need to disclose your personal data to prospective investors for due diligence purposes.

4.4 Intra-group administrative transfers

Minit companies’ personnel work collaboratively around the globe on marketing and business development activities and share experience, knowledge and resources. Transfers of personal data between and among Minit companies may be necessary in order to deliver Services to our customers efficiently and effectively.

Other Minit companies’ functions that involve the transfer of client-related and business contact personal data to selected members of management and personnel of Minit companies within and outside the EU and UK include financial management, client billing and administration, Minit group management and administration. 

Customer-related and business contact information collected in the course of networking and business development activities may be shared among personnel in our EU and UK Minit companies as well as with personnel in Minit companies outside the EU and UK.

Contractual arrangements governing international transfers of personal data to Minit companies or third parties outside the EU and UK are discussed in Section 5 below.  

4.5 Social media companies
We don’t provide personal data directly to social media companies but our website does use plugins for Facebook, LinkedIn and Twitter. Those entities are data controllers and have their own separate privacy policies.

5 Transfer of Personal data to Third Countries or International Organizations

Minit intends to transfer personal data to third countries, as some of our suppliers specified above in Article 4 and Minit companies may be domiciled, or their servers may be located outside the EU and UK, in particular in the United States of America (USA), Japan, Singapore or Australia. We carry out each transfer of personal data outside the EU/European Economic Area/UK in compliance with the provisions of the GDPR. We require that our suppliers or Minit companies located outside the EU/EU accede to the Commission (EU) approved standard contractual clauses, or to comply with other equivalent guarantees.

6 How Do We Protect Your Data?

At Minit, we continuously evaluate and modernize our implemented safety, technical and organizational measures to secure a safe processing of personal data. Electronic data are stored in a secured database on a server dedicated solely to Minit. We protect the personal data-storing database against damage, destruction, loss and unauthorized use. 7 How Long Do We Store your data

We store your personal data only for periods of time as may be required to attain the purpose for which your data have been collected. If we use your personal data for sending marketing communications, the storage period usually equals the period for which your consent has been granted, or until you withdraw the consent. If we process your personal data on the basis of our legitimate interest(s), they continue to be processed until the reason for the processing will have ceased to exist, or until you exercise your right to object to the processing. However, it needs to be said that even if a reason for processing of personal data personal data ceases to exist, this does not automatically mean that we erase your personal data. As a matter of fact, we may – and in certain cases we are required to – continue processing personal data for a different purpose (e.g. archiving) backed by other legal basis.

8 What Are Your Rights 

As we engage in processing of your personal data, you can of course exercise against us a number of rights described below. If you chose to exercise such rights either through this form, or if you write to privacy@minit.io, we will inform you of the manner of disposal of your request within 30 days of its delivery. In justified cases, this time limit may be extended to 60 days; in such a case, we will notify you in advance.

8.1 Right of Access

You have the right to obtain from us a confirmation whether we do, or do not process your personal data. If we do, you have the right to be provided with access to such personal data as well as information about the type of your personal data we process, for what purpose(s), to whom were your personal data disclosed, from what source we have obtained the data (unless we have obtained them from you), whether they were transferred to a foreign country, period of their archiving, as well as how to request rectification, deletion or restriction on the processing of your personal data, the right to object to such processing and the right to file a complaint to the relevant supervisory authority.

8.2 Right to Rectification 

We really care that we process only correct and complete personal data. If, however, you discover or believe that this is not the case, you have the right to request that we either rectify, or update your personal data.

8.3 Right to Erasure (Right to be Forgotten) 

You have the right to request that we erase personal data concerning you that we process, provided that no exemption stipulated by law applies, and that one of the following conditions is satisfied:

  • data are no longer needed for the purposes for which they have been collected;
  • you withdraw your consent to processing of personal data and, at the same time, there is no legal basis backing their processing;
  • you raise an objection to the processing of your personal data backed by one of our legitimate interests and, at the same time, there are no overriding legitimate interests backing their continuing processing, or you raise an objection to their processing for direct marketing purposes;
  • personal data were processed unlawfully.

Also, we will inform other recipients of your personal data that you have exercised your right of erasure. Accordingly, those additional recipients should erase all references/links to your personal data if this is feasible, having regard to the available technology and the costs of implementation of those steps.

8.4 Right to Restriction of Processing

You have also the right to request that we restrict the processing of your personal data, as long as one of the following reasons is concerned:

  • if you believe that your personal data we process are incorrect, until their accuracy is verified;
  • processing of your personal data is unlawful and you chose to request restriction of their processing rather than their erasure;
  • we no longer need your personal data for their processing; however, you may still need those data to evidence, enforce and defend your legal claims;
  • if you object to the processing of your personal data, until it is established whether legitimate reasons for their processing overrides your legitimate interests.

If your objection is successful and processing of your personal data is to be restricted, we will inform you in advance if restriction on processing is lifted.

8.5 Right to Data Portability

If we process personal data under a consent and/or under an agreement, and the processing is performed through automated means, you have the right to obtain those data in a structured, commonly used and machine-readable format. You may transfer those data also to third persons and, on your request, we will thus transfer your data directly to a processor of your choice, provided that this is technically feasible.

8.6 Right to Object

On grounds relating to your particular situation, you have the right to object to processing of your personal data carried out on the basis of our legitimate interest, including profiling based on our legitimate interest. Unless we demonstrate compelling legitimate grounds for the processing which override your rights and freedoms, we are no longer allowed to process your personal data.

If we process your personal data for direct marketing purposes, you have the right to object at anytime to such processing, which includes profiling to the extent that it is related to such direct marketing. If you object to such processing, we will no longer be allowed to process your personal data for those purposes.

In each marketing-related e-mail, we will offer you the possibility to unsubscribe if you no longer wish to receive marketing information from us. You can do so by clicking on the "Unsubscribe" link located at the bottom of our marketing e-mails.

8.7 Right to Withdraw Consent

If we process your personal data under a consent given by you, you are entitled to withdraw such consent at any time by filling this form or writing to privacy@minit.io.

However, please be aware that withdrawal of your consent has no bearing on legitimacy of any processing of your personal data under your consent prior to its withdrawal.

8.8 Filing Complaints 

If you believe that we process your personal data in breach of the applicable legal regulations governing the protection of personal data, you are entitled to lodge a complaint with our principal supervisory authority, namely the Office for Personal Data Protection of the Slovak Republic at the following address:

If your habitual residence or place of work is in another Member State of the European Union, you may lodge your complaint also with the supervisory authority in that Member State.

9 Profiling 

As part of Services, we also analyze the personal data you have furnished to us either directly, or that we derived from your internet browsing pattern, or that have been furnished to us by our suppliers. Based on that data, we create individual profiles in order to predict your future interests and display targeted advertising. It is our intention to show you only advertisements that are relevant and interesting to you.

We do not make any decisions based solely on automated processing of personal data that would have any legal effects whatsoever, or that would affect you in any significant way. As already mentioned, we create profiles solely with the aim to provide you with more attractive offers related to our Services, with the purpose to display targeted advertising, and also in order to assign to you an efficient person for communication, considering your location, job position or interests.

Our profiling does not include any special categories of personal data in the sense of Article 9(1) of the GDPR.

10 Personal Data Concerning Minors 

Minit does not, and does not intend to process personal data of persons below 16 years of age. Should we become aware of any processing of such data, this will be immediately discontinued and those personal data will be erased.

11 Why We Use Cookies On Our Website?

Like any other companies providing their service through the Internet, we too use cookies and other similar technologies. In this part, we attempt to explain to you how cookies work and why do we need them.

Cookies are small encrypted text files that are being saved on your computer or mobile device during website browsing sessions.

Individual cookies are stored on your device for different periods of time. Some cookies are deleted as soon as you close the browsing window (session cookies), some remain stored on your device also after termination of the browsing session (permanent cookies)

(i) basic website cookies – these are required to allow access to our website,
(ii) functional and technical cookies – these cookies are required for the proper performance of our website; without these cookies, our website would not function properly and are therefore strictly necessary;
